Terms and Conditions

These terms and conditions apply to the use of this website and any promotional e-mails and literature. By using this website and/or placing an order you agree to these terms and conditions.

Placing an Order: No contract for the supply of goods will be deemed to exist between you, the customer, and MyBirthFlower until the following has occurred:

- you place the order for products via the telephone, or website by pressing the confirm order button at the end of the chick-out process
- we send you an acknowledgement e-mail detailing the products you have ordered. This is not an order confirmation or order acceptance from us
- order acceptance and the completion of the contract between you and us will take place on the dispatch of the products ordered, whereupon we will send you a dispatch confirmaton e-mail, unless we have notified you otherwise.

Non-acceptance of an order may be a result of one of the following:

- the product you ordered being unavailable
- our inability to obtain authorisation for your payment
- the identification of a pricing or product description error.


Cancellation Policy:

We believe in customer satisfaction, so, if for any reason you are not satisfied with your product, please return the item within 7 days of receipt for a refund or exchange; all items must be returned in the condition you received them.

if you wish to exercise your right to cancel this contract prior to dispatch, please contact us immediately. If your order has already been dispatched please follow the procedure set out in our Returns Policy.

If cancellation of orders takes place after the items have been dispatched, refunds will be made less the cost of delivery.


Payment:

All prices quoted are UK Sterling, are inclusive of VAT at the current rates and are correct at the time of entering the information onto the website.

We accept payment by Visa/Mastercard/Switch/Solo/Maestro. All credit/debit card payments are subject to validation checks and authorisation by the card issuer. We will not be liable for any delay or non delivery if the issuer of your payment card refuses to or does not, for any reason, authorise payment to us. You confirm that the credit/debit card that is being used is yours.

You may also pay by sterling cheque made payable to MyBirthFlower Ltd but goods will not be dispatched until cleared funds have been received.

Returns Policy:

Returns should be made in the original, undamaged packaging and we reserve the right to withhold a percentage of the refund value of returned goods if the product or packaging is in such a condition that the item needs to be reduced in price for resale. Where goods are returned due to damages or fault delivery charges will also be refunded. This will not include the return portage costs. When goods are returned when no fault or damage is reported delivery charges will not be refunded.

Privacy and Security:

We respect the privacy of our customers and are committed to the following privacy policy, designed to give you peace of mind and confidence.

When making a purchase from MyBirthFlower we will ask for your name, billing and delivery address, telephone number, e-mail address, product selection, credit card or other payment details and a password.

We will use this information for processing orders.

-we need your name and contact details so that we can send you a confirmation as well as delivery of your gift
- we need your telephone number and e-mail address in the unlikely event that we need to contact you about your order
- we need your credit/debit card details so that we can collect payment for your order
- we may also use this information to let you know about any special offers/promotions we think would be of interest to you
- you agree that you do not object to us contacting you for any of the above purposes whether by telephone, e-mail or in writing and you confirm that you do not and will not consider any of the above as being a breach of any of your rights under the Privacy and Electronic Communications (EC Directive) Regulations 2003.

In the event that you do not wish to be contacted for such purposes then will be given the opportunity to opt out of receiving such information as you go through the ordering process. We need your credit/debit card details so that we can collect payment for your order.

How does MyBirthFlower protect customer information?

We ensure that all customer information, mailing address information and all data submitted to us is treated as highly confidential and in full compliance with the UK Data Protection Act 1998. All personal information is stored on secure servers and we also have a Firewall (security software) in place to protect our internal infomation from the internet.

We will not pass on your details to other companies for mailing or marketing purposes.
